Apple against Samsung patent war in court

Apple against Samsung patent war in court
Apple and Samsung return to San Jose, California court later so that a court can assess a jury decision to grant Apple's $ 1.05bn (£ 652 million) compensation.

The South Korean company wants patent judgment, or the sum reduced. In contrast, Apple claims the right to increase the amount and number of handsets his rival ban. If Samsung does not get that way, it can still against the ruling in the U.S. Court of Appeals and the U.S. Supreme Court.

The two tech Giants' handsets accounted for around 44% of the active U.S. smartphones, according to a recent study by ComScore. Apple has said that success depends on its ability to protect its patents to offer "significant products that is separate from the masses."

Samsung has warned customers that "less choice, less innovation, and potentially higher prices" face, if not victories.

Bankruptcy

Samsung's appeal for a new trial based on a claim that the jury foreman acted with "willful misconduct" during jury selection.

It argues that Velvin Hogan on a lawsuit that he had been involved from hard drive maker Seagate nearly 20 years ago that resulted in his bankruptcy "deliberately concealed information".

Samsung then bought a minority stake in the company.

"This is the rare case that juror misconduct requires a new trial because the jury foreman kept important information at the time it was important that he was revealing," Samsung's lawyers have demanded, saying they wanted Mr. Hogan has enabled service they had known of the matter.

Mr. Hogan told the BBC in August that the judgment could have been different if he is not selected. In another interview he told Bloomberg lawsuits instructions had said he needed only to disputes within the past 10 years to make known - something Samsung disputes.

Samsung has also introduced Apple's lawyers may know of the case, but kept quiet "for a tactical advantage." But while Apple's legal team has admitted that she learned that Mr. Hogan had filed for bankruptcy shortly after jury selection, it said "no attempt was made to obtain or revise" a court dossier why.

A lawyer said that it was impossible to be sure what the judge would make of all this.
